JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents and brother of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A,419 and 420 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands. It is alleged that on 28.9.2014 the husband of the informant took her to Kalyanpur from Purnea on the pretext of participating in Durga Pooja celebration but he left the informant at Khagaria and escaped from the scene. The accused persons kept all the ornaments of the informant and drove out from her matrimonial house.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.10574 of 2016 (2) dt.02-03-2016 2/2 that the accusation is omnibus and general against the entire inlaws family including the petitioners. The husband of the informant filed informatory petition no. 724 of 2013 on 22.3.2013 and 399 of 2015 on 20.2.2015 and thereafter the present case has been lodged on 19.12.2015. The informatory petition depicts in detail the torture inflicted by the informant to her in-laws family including the petitioners.

Considering the thrust of accusation against the husband of the informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM- V, Begusarai, in connection with Sahebpur Kamal P.S. Case No.423 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
