JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-09-2020 Heard learned counsel for the petitioner and the learned Additional P.P. through video conferencing. The petitioner apprehends his arrest in Complaint Case No.117 of 2019, registered under Section 498A of the Indian Penal Code and under Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is the husband of the daughter of the complainant. The petitioner is ready to keep his wife on all undertaking. The allegation of demand of dowry is false and concocted.

No.15238 of 2020(2) dt.08-09-2020 2/2 Taking into consideration the fact that the petitioner is ready to keep his wife with all honour and dignity, the petitioner is directed to surrender in the learned court below within six weeks from the date of receipt of this order and on such, the learned court below shall enlarge the petitioner on provisional anticipatory bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sasaram in connection with Complaint Case No.117 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. Thereafter the learned court below shall make efforts for resolution of the dispute between the husband and wife.

If the dispute between the husband and wife is resolved amicably, the learned court below shall confirm the provisional bail granted to the petitioner and if the dispute between the husband and wife is not resolved amicably, the learned court below shall pass order on the provisional bail of the petitioner immediately after lapse of six months.
