The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 508 of 2016, registered under Sections 30(A)/32(ii) of Bihar Prohibition and Excise Act, 2016. The allegation leveled against the petitioner is with regard to the fact that during patrolling duty, the informant and other police personnel chased and apprehended a Sumo Vehicle and upon opening of the gate of the vehicle several litres of country made illicit liquor and foreign liquor were recovered. Learned counsel for the petitioner submits that one Sudhanshu Mandal said to be the driver of the Sumo Vehicle was apprehended later on and on his confessional statement, he has
Patna High Court Cr.Misc. No.27063 of 2017 (2) dt.15-06-2017 2/2 stated the name of the petitioner. It is further submitted that the petitioner has nothing to do with the instant case and he is not the owner of the vehicle.
It is further submitted that the petitioner is in custody since 01.04.2017. It is further submitted that the said Sudhanshu Mandal has been granted regular bail by this court by an order dated 15.03.2017 passed in Cr. Misc. Case No. 11844 of 2017. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Amarpur P.S. Case No. 508 of 2016.
