The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including the petitioner herein are stated to have done the sister of the informant to death as a result of nonfulfiment of the demand of dowry.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason that he happens to be the father-in-law of the deceased. The husband of the deceased is in custody and his application for bail vide Cr. Misc. no.14698 of 2021 has been rejected. The petitioner who is the father-in-law of the deceased

Patna High Court CR. MISC. No.25001 of 2021(2) dt.23-11-2021 2/2 is in custody since 17.4.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner being father-in-law of the deceased, the husband of the deceased being in custody and the petitioner having remained in custody for 1 year and 7 months, the Court directs the petitioner to be enlarged on bail in connection with Budhuchak P.S. Case no.13 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.XIII, Bhagalpur.
