This is an application for bail in connection with Nagar P.S.Case No. 74 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code. Allegation against the petitioner is that he along with one accused has been apprehended along with stolen motorcycle. It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he is in custody since 2.3.2016 and so far other cases are concerned, petitioner is on bail in two other cases.

Heard learned APP also, who has opposed the prayer for bail stating that stolen motorcycle has been recovered from the possession of petitioner as well as he has been made accused in four other cases.

Having heard both sides and considering the aforesaid facts and circumstances and also considering the fact that petitioner is in custody for the last 15 months, let the petitioner, named above, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.27030 of 2017 (3) dt.12-07-2017 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Nagar P.S.Case No. 74 of 2016, subject to the conditions that :- (i) One of the bailors of the petitioner shall be his family member having sufficient immovable properties within the jurisdiction of the concerned Court. (ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.

(iv) If active involvement of the petitioner in such type of case is found in future, his bail bond shall be cancelled.
