The petitioner apprehends his arrest in connection with Mahua P.S. Case no. 253 of 2018, registered under Sections 341, 323, 324, 504, 307 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that on 13.08.2018, Aditya Kumar @ Bittu and petitioner accompanied the informant Sudarshan Kumar from his house on the pretext of walk and all reached near Gayatri Brick-kiln, where Ganesh Singh Chandan Singh and Bhupesh Singh were already present. On seeing the informant, Ganesh Singh told that Chandan, man we were looking for is here, Aditya and Bittu got our work done. Thereafter, Bhupesh Singh caused firearm injury at his belly.

Patna High Court CR. MISC. No.16457 of 2019(3) dt.20-06-2019 2/2 On hearing the sound of firing villagers reached there then all the accused fled away. Thereafter, informant was taken to Mahua hospital then to Sadar Hospital Rajipur from where he was referred to PMCH.

Learned counsel for the petitioner submits that petitioner and Aditya were walking with the informant, when Bhupesh Singh fired on the instruction of Chandan Singh. The petitioner has falsely been implicated in this case mere on suspicion. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 253 of 2018, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
