The petitioner seeks anticipatory bail in connection with Chainpur P.S. Case No. 295 of 2018 pending in the Court of the Special Judge, Excise, Kaimur at Bhabhua, for offences under Sections 279 and 304A of the Indian Penal Code and 30(A) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that the vehicle which was driven by the petitioner dashed the mother of the informant, who died on the spot. The vehicle fell turtle. From the vehicle 150 mili liters of Indian made foreign liquor was recovered.

Having considered the judgment of the Full Bench passed in Criminal Appeal (SJ) 431 of 2019, dated 17.05.2019, (Ram Vinay Yadav vrs. the State of Bihar), the petitioner is directed to move the trial Court for regular bail.
