====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-03-2022 Heard learned counsel for the petitioners and learned A.P.P for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 323, 342, 504, 506, 34 of the Indian Penal Code, Sections 3, 4, 5 and 6 of the Immoral Trafficking Act and Sections 8 and 12 of the Protection of Children From Sexual Offences Act.

The prosecution case in brief is that a girl aged about 16 years has alleged that her mother, maternal grandfather, maternal grand-mother and maternal aunt are forcing

When the informant resisted, the accused persons assaulted her and stopped giving food to her. The victim thereafter called to the Superintendent of Police, Rohtas and told that her honour will be spoiled as the accused persons have locked her in a room with some persons and she saved her modesty by pleading before those persons.

It is submitted by learned counsel for the petitioners that the victim was having love affairs with some person and she was trying to run away and when they stopped her to do so, this false case has been lodged against the petitioners. The family is engaged in dance profession and she was tuitioned for becoming a singer. The petitioners belong to case Nat and they earn their livelihood from dance programme.

From perusal of the case diary, it appears that vide para 52 of the case diary, the informant, minor girl, aged about 16 years has supported the prosecution case and the complicity of the petitioners who happen to be the mother and own relatives of the informant.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.25134 of 2021(4) dt.22-03-2022 3/3 case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

The prayer for grant of anticipatory bail to the petitioners stands rejected.
