2. The present application has been filed for modification of the order dated 04.07.2025 passed in Cr. Misc. No. 41333 of 2025 passed by this court granting anticipatory bail to the petitioner.

3. Learned counsel for the petitioner submits that by the aforesaid order dated 04.07.2025, the petitioner was granted bail and four week's time was given to surrender and furnish the bail bond, however, on account of some personal liability and the petitioner having been stationed outside the State to earn his livelihood, he could not surrender and furnish the bail bond

It has thus been prayed that the petitioner had not deliberately delayed his surrender before the learned court below for furnishing the bail bond and in fact because of the extreme circumstances and reason beyond his control, he could not surrender in time and furnish his bail bond. It has thus been prayed that the period for furnishing bail bond may be extended for the period of four weeks.

3. Learned A.P.P. for the State has vehemently opposes the application and states that the petitioner has taken more than seven months in filing the present modification.

4. Considering the aforesaid submission made by the parties, the order dated 04.07.2025 passed in Cr. Misc. No. 41333 of 2025 is modified to the extent that the petitioner is granted further four week's time from today to furnish bail bond of Rs. 10,000/-with two sureties of the like amount each to the satisfaction of the learned court concerned at Darbhanga in connection with Ashok Paper Mill (APM) P. S. Case No. 116 of 2024, subject to the condition as laid down in the earlier order dated 04.07.2025. The petitioner shall deposit an amount of Rs. 5,000/- before the Bar Association, Patna High Court and proof of such payment shall be filed along with the application, prior to the furnishing the bail bond.

5. The present application stands allowed and the order dated 04.07.2025 passed in Cr. Misc. No. 41333 of 2025 is modified to the aforesaid extent and there would no change in the rest of the order dated 04.07.2025.
