The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 427, 379, 504 of the Indian Penal Code.

It is a case of abusing and assaulting to the brother of the informant due to which he succumbed to injuries.

It is submitted by learned counsel for the petitioner that the petitioner being the Mukhiya of the village, has falsely been implicated in the present case

Patna High Court CR. MISC. No.14300 of 2022(3) dt.12-10-2022 2/3 due to village politics. This fact is also supported by several independent witnesses. It is further submitted that petitioner was not sent up for trial and final form has been submitted but differing with the final form, cognizance has been taken against the petitioner. It is also submitted that there is general and omnibus allegation and there is no specific allegation of assault against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Mukhdumpur P.S. Case No. 453 of 2019, subject to the conditions as laid down
