Petitioner is aggrieved by the letter dated 27.11.2014, which is a notice contained in Annexure 1, by which he was directed to show-cause as to why he should not be black-listed for not completing the work to the satisfaction of the respondents. The reason of satisfaction has been disclosed in Annexure 1. Learned counsel for the petitioner submits that he had submitted the reply to the aforesaid show-cause notice vide Annexure 2 dated 5.12.2014 but no decision has been taken by the authority
Patna High Court CWJC No.1519 of 2015 dt.18-02-2015 concerned as yet and, as such, payment of his amount of Rs. 61,62,450/- has been kept unnecessarily pending. In above view of the matter, this writ application is being disposed of with a direction to the respondent no. 5, i.e., the Managing Director-cum-Chairman, Bihar State Power Holding Company Limited, Vidyut Bhawan-I, Patna, to dispose of the matter considering the reply of the petitioner to the show-cause notice contained in Annexure 1 either by himself or get it disposed of by the respondent no. 2, i.e., the Chief Engineer Civil, Bihar State Power Holding Company Limited, Vidyut Bhawan-I, Patna, who had issued the show-cause notice, within a period of six weeks from the date of receipt/production of a copy of this order.
After taking such decision, the admitted dues of the petitioner, if any, should immediately be paid to him. (Dr. Ravi Ranjan, J) SC/- U
