This is an application for bail in connection with Mahakar P.S.Case No. 57 of 2016 registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused and it appears that petitioner has been made accused in 11 other cases. It has been submitted on behalf of the petitioner that petitioner has been released on bail in four other cases and other co-accused have been granted bail and petitioner is in custody since 15.2.2017.
Heard learned APP also, who has opposed the prayer for bail stating that petitioner has criminal antecedents.
Patna High Court Cr.Misc. No.26944 of 2017 (3) dt.12-07-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.
However, learned trial court is directed to expedite the trial and try to conclude it within a year. At the same time, Sr.Superintendent of Police, Gaya is directed to ensure the presence of the witnesses in court.
Accordingly, this application is dismissed.
