2. The petitioner seeks bail in connection with Balua Bazar PS Case No. 37 of 2023 instituted for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-B) a 26 and 35 of the Arms Act.

3. As per the prosecution case, one country made pistol and one live cartridge has been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He further submits that chargesheet has already been submitted in this case. Petitioner is in custody since 07.05.2023.

5. Learned APP opposes the prayer for bail.

6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-I, Supaul dated 08.12.2023, it appears that petitioner is named in the FIR. The petitioner in his confessional statement and other accused persons in their respective confessional statement have detailed about their involvement. It is also alleged that informant in his re-statement and the other witnesses have also supported the prosecution case. Similarly situated co-accused persons namely, Ujjwal Kumar @ Ujjwal Yadav and Vijay Kumar Mandal @ Vijay Kumar have been granted bail by this Court in Cr. Misc. Nos. 74877 of 2023 and 78412 of 2023 vide order dated 24.11.2023 and 06.12.2023, respectively and period of custody, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Supaul in connection with Balua Bazar P.S. Case No. 37 of 2023.
