The petitioner has preferred this application for grant of regular bail in a case registered under sections 399 and 402 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of Arms Act.

As per the prosecution case, on secret information having been received with respect to six-seven accused persons having gathered, it is stated that the informant reached there. Seeing the police personnel the accused made an attempt to escape but one of them namely, Jitu Kumar Singh, was caught with arms and ammunition as stated in the FIR. On his disclosure about the name of the accused persons who had

On perusal of the material on record it transpires that the petitioner was not arrested at the alleged place of occurrence but his name transpired in the statement of co-accused Jitu Kumar Singh. No incriminating article was recovered from the petitioner's possession who is in custody since 27.5.2021 and charge-sheet has been submitted in the case.

Having heard learned counsel for the State and taking into consideration the facts and circumstances stated herein above together with the petitioner being in custody since 27.5.2021, the petitioner is directed to be enlarged on bail in connection with Desari P.S. Case no. 186 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur.
