JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The petitioner's wallet, motorcycle, ATM card and identification card were robbed. The petitioner was identified by the informant and other witnesses.
It is submitted by learned counsel for the petitioner that for the occurrence of 28.11.2012, the FIR was registered on 11.12.2012 and the petitioner is accused in one other case apart from present one.
The delayed lodging of the FIR constitutes good ground for consideration of regular bail.
Let the learned court below consider the regular bail of
Patna High Court Cr.Misc. No.1445 of 2015 (2) dt.14-01-2015 2/2 the petitioner if he surrenders within a period of six weeks in connection with Rosera P.S. Case No. 295 of 2012 pending in the court of learned ACJM, Rosera, Samastipur.
Accordingly, the application is disposed of.
