The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 353, 332, 504, 506 of the Indian Penal Code.
The prosecution case is that the police received information that one Jairam Singh indulging in illicit sale of liquor in spite of earlier case being Mali P.S. Case No. 48 of 2015. When the informant went to raid the wooden shop of Jairam Singh then on his call First Information Report named accused persons including the petitioner along with 20 to 30 unknown attacked on the police force and raised slogan against the administration. Patna High Court Cr.Misc. No.10628 of 2016 (2) dt.10-03-2016 petitioner that accusation is omnibus and general against the mob. No injury was caused to the police force and in fact the police was extracting money from Jairam Singh, which was protested by the villagers hence, the present case has been lodged.
Considering the accusation being omnibus and general against mob, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No. 06 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
