====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 17-01-2017 Heard the learned counsel, Mr. Baidhnath Thakur, for the petitioner.

Perused the impugned order dated 06.09.2016 passed by Sub Judge IV, Patna in Eviction Suit No.39 of 2012 whereby the Court below directed the petitioner to pay rent at the rate of mentioned in the ordersheet in exercise of jurisdiction under Section 15 of the Bihar Building (Lease, Rent & Eviction) Control Act, 1982.

From perusal of the impugned order, it appears that the Court below found that there is no dispute regarding relationship of landlord and tenant and also tendering of rent @ 4465/- per month by the petitioner to the plaintiff through impugned order and, therefore, directed the petitioner to pay the said rent per month since the month of June, 2012 and go on depositing the same in term of Section 15 of the Building (Lease, Rent &

Patna High Court C.Misc. No.6 of 2017 (2) dt.17-01-2017 2/2 Eviction) Control Act, 1982, therefore, I do not find any jurisdictional error in the impugned order and accordingly, this Civil Misc. application is dismissed.
