The petitioners seek regular bail in connection with Bihariganj P.S. Case No. 104 of 2017, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The accusation against the petitioner is with regard to recovery of certain quantities of mahua wine/ country made liquor from the petitioner.

The learned counsel for the petitioner submits that the petitioners are petty labourers and have been falsely implicated in the case. The petitioners do not have any criminal antecedent and they are in custody since 24.03.2017.

Patna High Court Cr.Misc. No.27313 of 2017 (2) dt.15-06-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.

Accordingly, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Bihariganj Case No. 104 of 2017.
