2. The petitioner makes a prayer for grant of regular bail in connection with Azamnagar P.S.Case No. 09 of 2025 registered under sections 8 (c), 21(a), of the NDPS Act.

It appears from the perusal of the FIR would show that the petitioner Deepak Kumar started fleeing away on seeing the patrolling party upon which, he was searched and total 1.270 gm smack and a mobile phone was recovered from possession of the petitioner. Complying with the provisions of the seizure in presence of the seizure list witnesses.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. It is further submitted that the very recovery of 1.270 gm smack shows that it is even less than the small quantity of smack as per schedule.

No.14660 of 2025(2) dt.19-03-2025 2/3 Learned counsel for the petitioner points out the fact that the petitioner is a person of clean antecedent and is ready to abide by the terms and conditions as laid down by this Hon'ble Court. The petitioner is in custody since 07.01.2025 and the recovery of smack being even less than small quantity makes the petitioner definitely entitled to the privilege of bail.
5. However, I would also like to make comment with regard to the fact that the cases involving very small or even less than small quantity of contraband, should not be traveling up to the Hon'ble High Court, so that the precious time of the Hon'ble Court would be saved.
6. Be that as it may, in view of the above mentioned facts and circumstances, the petitioner is enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with Azamnagar P.S.Case No.09 of 2025, subject to the condition that one of the bailors shall be own/ close member of the family of the petitioner.
