JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/ 307/ 302/ 121A/ 452/504 of the Indian Penal Code and Sections 16/17/18/19/20/21/22 of the U.A.P. Act.

Co-accused Birendra Yadav allegedly fired at the son of the informant on the order of co-accused Sanjay Yadav as a result whereof Hemant Yadav the son of the informant died. The petitioner was also identified in the mob. In similar circumstances, co-accused Sudama Yadav and Rakesh Yadav have already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.25163 of 2017 vide Annexure-2.

No.18731 of 2018 (2) dt.04-04-2018 P2/ Considering the fact that there is no overt act alleged against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sono (Charkapathar) P.S. Case No.146 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
