The petitioner, in the present case, is seeking anticipatory bail in connection with Hajipur Town P.S. Case No. 312 of 2018 registered for the offences under Section 420, 467, 468, 471 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he along with one Sunil Sah had called the informant on 11.04.2018 in the name of providing him some carpenting work but then the informant was confined in room no. 112 of one Litchvi Hotel at Anwarpur Chowk, Hazipur. Patna High Court CR. MISC. No.14289 of 2019(2) dt.11-03-2019 2/3 conspiracy got prepared a sale deed in respect of his ancestral land and then by taking Anjani Kumar and Ranjit Kumar Pawan as witnesses they got the sale deed executed and registered.
Learned counsel for the petitioner submits that so far as the sale deed is concerned, the informant has himself executed the sale deed on 11.04.2018 itself which will be apparent from a perusal of the copy of the deed. A web copy of the deed has been brought before this court for perusal. It is submitted that the photograph of the informant is very much present on the sale deed as executants of the document. It is submitted that the sale deed is not in the name of the petitioner. It is submitted that only as an afterthought the present case has been registered on 27.04.2018.
Learned A.P.P. for the State is present and has opposed the prayer for anticipatory bail of the petitioner. Having considered the rival submissions and the materials placed before this court, taking note of the submissions of learned counsel for the petitioner that the sale deed was executed by the informant on 11.04.2018

No.14289 of 2019(2) dt.11-03-2019 3/3 itself whereas the complaint case giving rise to present police case has been registered on 27.04.2018 as also that the petitioner has got no criminal antecedent, in the event of his arrest/surrender in the court below within a period of four weeks from today, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like each to the satisfaction of learned C.J.M., Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No. 312 of 2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
