JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2013 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.

Petitioner apprehends his arrest in connection with Sultanganj Police Station Case No. 152 of 2013 registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code.

Petitioner is named in the First Information Report with accusation that he ordered to assault the deceased and on his instigation, the other accused assaulted the deceased. Considering the nature of allegation levelled against the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

However, it is made clear that if petitioner surrenders

Patna High Court Cr.Misc. No.39455 of 2013 (2) dt.23-12-2013 and seeks regular bail this order shall not cause prejudice to the court concerned at the time of consideration of regular bail application of the petitioner.
