This is an application for bail in connection with Naubatpur P.S.Case No. 111 of 2016, corresponding to G.R.No. 1242 of 2016, registered for the offences punishable under Sections 304B, 302, 201 and 34 of the Indian Penal Code. Allegation against the petitioner is of dowry death and petitioner is husband.
It has been submitted on behalf of the petitioner that as a matter of fact, the girl fled away and petitioner has been made accused in this case and no specific allegation has been attributed to the petitioner and petitioner is in custody for one year. Heard learned APP also.
Having heard both sides and in view of the fact that
Patna High Court Cr.Misc. No.27174 of 2017 (2) dt.12-07-2017 2/2 earlier there was demand of dowry and thereafter the girl was traceless and the allegation is that petitioner has killed her, I am not inclined to grant bail to the petitioner. However, learned court below is directed to take steps for commitment of the case and thereafter learned trial court is directed to expedite the trial and try to conclude it within nine months.
With the above observation, this application is dismissed.
