JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Kochas P.S. Case No. 30 of 2017 for the offence under sections 414 of the Indian Penal Code.
From the FIR, it appears that petitioner was apprehended in this case for non-production of valid paper of the motorcycle. The police proceeded against the petitioner keeping in view the vehicle to be stolen. The submission on behalf of the petitioner is that he was not aware of the fact that the motorcycle was stolen. He was simply driving the motorcycle on bonafidy believe that the motorcycle is not stolen one. Be that as it may, the petitioner has stated in para-3 that he is a man of clean antecedent and the fact that he has not made any attempt to flee away at the
Patna High Court Cr.Misc. No.27139 of 2017 (2) dt.01-07-2017 2/2 time police stopped him and demanded relevant document in support of ownership of the vehicle.
Having regard to the facts stated above and the facts that he is in custody since 4.3.2017 and he has clean antecedent as per statement on affidavit in para-3, I am inclined to enlarge the petitioner, named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Sasaram, Rohtas or successor court , in connection with Kochas P.S. Case No. 30 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
