The petitioner seeks bail in Mohania P.S. Case No. 275 of 2012, registered for the offence punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case, there was illicit relation between the mother of informant (deceased) and the co-accused Munnu Tiwari who killed informant's mother. This petitioner is labourer of Munnu Tiwari who used to call the deceased daily in the house of Munnu Tiwari.

It is submitted on behalf of the petitioner that specific allegation of commission of murder is against co-accused Munnu Tiwari and the only allegation against this petitioner is that he used to call informant's mother (deceased) daily at the instruction of Munnu Tiwari to his house. No case under Section

Patna High Court CR. MISC. No.13868 of 2022(2) dt.10-05-2022 2/2 302/34 IPC is made out against this petitioner. Co-accused Munnu Tiwari has already been granted bail by this Court vide order dated 24.02.2020 passed in Cr. Misc. No. 8815 of 2020 vide Annexure-3. Petitioner claims clean antecedent and he is in custody since 07.01.2022.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 9th, Kaimur at Bhabhua in connection with Mohania P.S.
