JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The petitioners seek regular bail in connection with Pipra Kothi P.S. Case No. 209 of 2016, registered for offences punishable under Sections 392, 412, 328 and 34 of the Indian Penal Code and Section 25(1-B)A-26, 35 of the Arms Act. Prosecution case in short that informant while on patrolling found that two trucks were standing on the road, and petitioners were looting those trucks and on search from the possession of the petitioners, fire arms were recovered. It has been submitted on behalf of the petitioners that they have falsely been implicated in this case only on the basis of suspicion and nothing has been recovered from their possession and they have been in judicial custody since 23.12.2016.

Patna High Court Cr.Misc. No.27211 of 2017 (2) dt.12-07-2017 2/2 Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioners on bail, this application for grant of regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude as soon as possible.
