2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 1138 of 2024 instituted for the offences under Sections 126(2), 115(2), 118(i), 109, 329(4), 324(6), 3(2), 3(5), 351, 325 of the BNS.

3. Prosecution case, in short, is that, on the alleged date and time of occurrence, 8 to 10 persons came in the shop of the informant and three of them including this petitioner entered his shop and started abusing him.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel for the petitioner submitted that general and

No specific overt act is alleged against the petitioner rather the specific allegation of assaulting on the head of the informant is against co-accused Santosh Yadav. It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.12.2024 and has one criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, there being no specific allegation against the petitioner as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Muffasil P.S. Case No. 1138 of 2024.
