The petitioner seeks bail in Kotwali (Tilkamanjhi) P.S. Case No. 683 of 2021, registered for the offence punishable punishable under Section 30(a)/32 of the Bihar Prohibition and Excise Act, 2016.

42.375 litres of foreign liquor has been recovered from the house of co-accused Pankaj Jha and this petitioner was apprehended on the spot.

It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from the house of co-accused Pankaj Jha. Petitioner is in custody since 09.10.2021 having no criminal antecedent, as

Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court-II, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 683 of 2021.
