Petitioner, already in custody, seeks bail in connection with Akbarnagar P.S. Case No.98 of 2017, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner contends that the vehicle from which recovery of illicit foreign liquor is said to be made is not of the petitioner, the petitioner is said to have made an attempt to drive away the vehicle and in the FIR it is stated that a copy of the seizure list was received by the petitioner but there is no signature of the petitioner on the seizure list, the petitioner has clean antecedent and he is in custody since 27.11.2017. Having considered the said facts and circumstances, petitioner Vishwajeet Kumar is directed to be released on bail

Patna High Court Cr.Misc. No.4702 of 2018(2) dt.31-01-2018 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Bhagalpur in connection with Akbarnagar P.S. Case No.98 of 2017.
