====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 22.11.2021, charge-sheet has been submitted in this case and has antecedent of two cases. Allegation is of recovery of 216 litre of liquor from a four wheeler.

The learned counsel for the petitioner submits that petitioner is neither the owner, nor the driver of the vehicle. He was mere a passer-by, who came to be implicated when search was being made.

Patna High Court CR. MISC. No.15027 of 2022(2) dt.08-04-2022 2/2 Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Laukaha P. S. Case No.357 of 2021.

The application stands allowed.
