JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Nauhatta P.S. Case No. 01 of 2017 for the offence under sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
From the FIR, it transpire that 20 liters illegal country-made wine and 10 liters of Mahua wine kept in a gallon was seized by the police on search from the shop of the petitioner. In sum and substance, there is allegation against the petitioner that he is engaged in illegal business of wine. Counsel for the petitioner submits that the name of the petitioner in the instant case surfaced on the confessional statement of co-accused Ram Pravesh Musahar. In fact, the
Patna High Court Cr.Misc. No.27264 of 2017 (2) dt.01-07-2017 2/2 petitioner is not in any manner involved in the illegal business of liquor.
The petitioner is in custody since 12.4.2017. In paragraph 3 on affidavit there is statement that petitioner has clean antecedent.
Having regard to the facts that the petitioner has stated in para-3 that he has clean antecedent and his name has come in the confessional statement of co-accused and the fact that the petitioner is in custody since 12.4.2017, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Court Excise, Rohtas at Sasaram, in connection with Nauhatta P.S. Case No. 01 of 2017 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
