JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-11-2021 Heard Mr. Surendra Kumar Singh, the learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 285 of 2016 instituted for the offences under Sections 302/34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 04.03.2020 passed in Cr. Misc. No. 64568 of 2019.

On 28.07.2021, this Court had called for a report about the stage of the case from the court below. The report which has since been received indicates that there has not been any substantial progress in the trial and no witness

The petitioner is said to be in custody since 20.11.2017.

However, regard being had to the nature of accusation, I am not inclined to grant bail to the petitioner for the present but looking at the period of custody of the petitioner, this Court directs that if there is no substantial progress in the trial within the next six months, the petitioner would be at liberty to approach the Trial Court for grant of bail and in that event the Trial Court would be required to state the reasons for tardy pace of trial.
