Petitioner, already in custody, seeks bail in connection with Forbesganj PS Case No.82 of 2018 registered under Section 420 of the Indian Penal Code as well as under Sections 3⁄4 of the Examination Conduct Act, 1981.
Allegation is that the petitioner was impersonating his younger brother and appearing on his place in the intermediate examination.
Submission is that the offence is attracted under the Examination Conduct Act, 1981 and the petitioner is in custody since 09.02.2018.
Having considered the aforesaid facts and circumstances, petitioner Suraj Kumar is directed to be released
Patna High Court Cr.Misc. No.22864 of 2018(2) dt.18-04-2018 2/2 on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj PS Case No.82 of 2018.
