JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 It is submitted that petitioner no.3, Awadhesh Singh @ Rinku Singh has been arrested, hence application to the extent of his prayer has become infructuous.

Heard learned counsels for the petitioners and the State. Petitioner nos. 1 and 2 are apprehending arrest in a case registered for the offences punishable under Sections 323, 504, 354, 379 and 307 of the Indian Penal Code.

It is alleged that when the wife of the informant went to pluck the pumpkin, all the accused persons made protest, abused and assaulted the informant with lathi and danda and when the family members of the informant came to rescue, they were also assaulted.

Considering the aforesaid facts, let the above named petitioner nos. 1 and 2 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Koransarai P.S. Case No. 78 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
