Petitioner, already in custody, seeks bail in connection with Madhepura P.S. Case No.461 of 2017, registered under Sections 406 and 420 of the Indian Penal Code. Allegation in brief is that one unknown person asked the informant to give lift on his motorcycle and when they reached at a place, on some pretext the petitioner took away his motorcycle and did not return back and the motorcycle is recovered from possession of the petitioner for which another case was instituted.
Learned counsel for the petitioner submits that with regard to recovery of motorcycle, petitioner was in custody and was granted bail. In the present case, the FIR is against
Patna High Court Cr.Misc. No.18566 of 2018(2) dt.02-04-2018 2/2 unknown, petitioner has not been put on TIP to ascertain he was the person who took away the motorcycle and the petitioner is in custody since 18.01.2018.
Having considered the said facts and circumstances, petitioner Lal Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura P.S. Case No.461 of 2017.
