JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 8, 20(A)(i) and 29 of the NDPS Act.
From the house of the petitioner, two cannabis plats were recovered.
It is submitted by learned counsel for the petitioner that recovery has been made from the native place of the petitioner, though, the petitioner works outside the state and stray plants cannot come within the purview of cultivation. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, this Court is not
Patna High Court Cr.Misc. No.10635 of 2016 (2) dt.03-03-2016 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Hilsa P.S. Case No. 15 of 2016 pending in the court of learned Special Judge-cum-District & Sessions Judge, Nalanda, Biharsharif.
Accordingly, the application is disposed of.
