JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in a case instituted under Sections 341, 324, 307, 448, 506, 120(B), 34 of Indian Penal Code.

It is alleged that at about 11:00 P.M. on 09.11.2015 her husband was shot dead and she saw Santosh Yadav and Subhash coming out her house with arms. It is further alleged that associates of the accused persons were standing outside with motorcycle. The petitioner's name has subsequently figured in course of the investigation.

The petitioner submits that he is not named in the F.I.R. Furthermore, one Dhanik Lal Yadav, having more or less similar allegation, have been granted anticipatory bail.

No.11563 of 2016 (2) dt.31-03-2016 2/2 Having regard to the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner named above, be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of Shri V. N. Prasad, J.M. 1st Class, Saharsa or his successor, in connection with Bihra P.S. Case No. 211 of 2015, on the following conditions:- (i) He would not physically absent for two consecutive dates at a stretch, till two witnesses are examined in the case. (ii) If he is found involved in a similar case in future, the informant would be at liberty to file a petition for cancellation of his bail.

(iii) The petitioner would go to the Police Station once in every six weeks and would file an affidavit to that effect before the court concerned.
