JUSTICE BIRENDRA KUMAR ORAL ORDER 04-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act and Sections 27(b)(ii)/23/36 of the Drugs and Cosmetic Act. According to FIR, some cough syrup containing codeine were recovered from the shop of co-accused Salim. Salim disclosed to the police that co-accused Md. Faizan Tabrej and the petitioner used to supply the same. Thereafter house of Md. Faizan Tabrej was raided and from there one country-made pistol and 14 cartridges were recovered and some cough syrup was also recovered and the petitioner was also found there. Submission is that the petitioner is in custody since

Patna High Court Cr.Misc. No.18737 of 2018 (2) dt.04-04-2018 P2/ 16.12.2017. The investigation is already complete and nothing has been recovered from the possession of the petitioner. Petitioner is ready to cooperate with the trial. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail after framing of the charge or after two months from today whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Forbesganj (Simraha) P.S. Case No.942 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
