The petitioner is languishing in custody since 09.11.2018 in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

It is alleged that from the conscious physical possession of the petitioner, one stolen mobile phone was recovered.

It is submitted by learned counsel for the petitioner that the recovered mobile phone has not been put on T.I. Parade and the investigation has already been concluded. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.15760 of 2019(2) dt.14-03-2019 2/2 Learned APP submits that the recovery has been made from the physical conscious possession of the petitioner. Considering the nature of accusation and the fact that the investigation has already been concluded, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- IVth, Madhubani in connection with Deodha P.S. Case No. 129 of 2018.
