Petitioners apprehend their arrest in connection with Benipatti P.S. Case No. 74 of 2013 registered under Sections-341, 323, 354, 420, 406, 379, 504/34 of the Indian Penal Code. No doubt, charge sheet has already been submitted against the petitioner for the offence under Section-406 of the Indian Penal Code but according to prosecution case, the alleged occurrence took place in the year, 2011 and the complaint petition i.e. Complaint Case No. 83 of 2013 was filed in the year, 2013 and on the basis of aforesaid complaint petition, the present case has been registered.
Considering the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition
Patna High Court Cr.Misc. No.2399 of 2015 (2) dt.20-01-2015 2/2 is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioner, named-above, shall be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Benipatti P.S. Case No. 74 of 2013 to the satisfaction of Chief Judicial Magistrate, Madhubani subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
