The petitioner seeks bail in a case registered for the offence under Sections 272, 273 of the I.P.C. and Sections 30(a), 36, 52, 53 of Bihar Prohibition and Excise Act. 8.910 liters of illicit foreign liquor has been recovered from the house of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from the house, which is in joint possession of the family. Petitioner has no criminal antecedent of similar nature and he is in custody since 02.12.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of

Patna High Court CR. MISC. No.13532 of 2022(3) dt.17-05-2022 2/2 custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Muzaffarpur in connection with Brahampura P.S. Case No. 83 of 2021.
