JUSTICE ARUN KUMAR ORAL ORDER 19-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Bibhutipur PS Case No. 102 of 2017 registered under Sections 341, 323, 324, 307, 302, 504 and 506/34 of the IPC.

The allegation in brief is that all the named accused persons were assaulting Amresh Choudhary, brother of the informant, as a result he succumbed to the injury.

Learned Counsel for the petitioner submits that there was quarrel between the parties on trivial issue, there is no specific allegation of assault against the petitioner or any other accused, investigation is complete, many witnesses have stated that it was an accidental death as due to quarrel the deceased made an attempt to run away and in that process was hit by the vehicle. Having considered the said facts and circumstances, the petitioner, namely, Mantun Choudhary @ Manikant Chaudhary is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Rosera, Samastipur in connection with Bibhutipur PS Case No. 102 of 2017.
