2. The petitioner is seeking regular bail in connection with Karja P.S. Case No. 269 of 2024, registered for the offences punishable under Sections 137(2), later added Sections 103(1), 3(5) of the BNS.
3. As per allegation, some unkonw persons kidnapped the son of the informant.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that there is nothing against him in the entire case diary, except the confessional statement of co-accused Jai Rai @ Jai Mangal Rai, with whose wife the deceased is alleged to have had illicit relations. Jai Rai @ Jai
Patna High Court CR. MISC. No.12779 of 2025(3) dt.15-05-2025 2/2 Mangal Rai, in his confessional statement, has stated that the petitioner was also involved in the murder of the deceased. The petitioner is a person of clean antecedents and is under custody since 19.12.2024.
5. On the other hand, the learned counsel for the informant has opposed the prayer for bail.
6. It appears that, except for the confessional statement of the co-accused, which is not leading to recovery, there is nothing against the petitioner.
7. Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, West Muzaffarpur in connection with Karja P.S. Case No. 269 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
