JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned Counsel for the petitioners and the learned Counsel for the State.

Both the bail applications (Cr. Misc. No. 4185 of 2018 and Cr. Misc. No. 4191 of 2018) are being disposed of by this common order as they arise out of the same FIR.

Petitioners, already in custody, seek bail in 323 PS Case No. 2017 registered under Sections 147, 148, 149, 332, 353, 153A, 295, 295A, 435, 427, 307, 337, 338, 323 of the IPC and Section 27 of the Arms Act.

Patna High Court Cr.Misc. No.4185 of 2018 (2) dt.01-02-2018 Learned Counsel for the petitioners submits that there is general and omnibus allegation against the petitioners of disturbing the communal harmony, but there is no any specific allegation, similarly situated co-accused persons have been admitted to bail and there is no injury to anyone.

Having considered the said facts and circumstances, the petitioners namely Md. Tuntun @ Gulam Mustafa, Md. Farid Ahmad @ Md. Farid and Md. Manzoor @ Md. Manzoor Alam are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) by each one of them with two sureties of the like amount each to the satisfaction of CJM Jamui in connection with Jamui PS Case No. 323 of 2017.
