JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-09-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 376, 498A/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The prosecution case is that the petitioner ravished the informant and thereafter performed marriage but subsequently torture was inflicted.
It is submitted by learned counsel for the petitioner that the matter was referred to the Mediation & Conciliation Centre of the Bihar State Legal Services Authority vide order dated 25.04.2016 and during mediation both sides decided to part ways on payment of Rs. 1,50,000/-. The report of the Mediator at Flag-D dated 28.07.2016 also suggests the same.
Patna High Court Cr.Misc. No.9139 of 2016 (7) dt.08-09-2016 2/2 Learned counsel for the informant does not controvert the contention of the counsel for the petitioner and is not opposing the prayer for bail of the petitioner. The petitioner and the informant are present in the Court. The informant accepts to receive Rs. 1,50,000/- as one time settlement amount, though petition to that effect has not been filed on affidavit by the parties. Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jhanjharpur in connection with Rudrapur P.S. Case No. 57 of 2015, G.R. No. 1012 of 2015.
