JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody since 20.11.2017, seek bail in connection with Dariyapur P.S.Case No. 295 of 2017 registered under Sections 147, 148, 302, 307, 323, 324, 341, 448, 504 and 506 of the Indian penal Code.

Allegation in brief is that one Dasharath Sah assaulted the informant's son with spear as a result he failed down, thereafter others assaulted with lathi and danda.

Submission is that specific allegation of doing assault with lethal weapon is against Dasharath Sah and no specific allegation against these petitioners and petitioner no. 1 is a married girl and petitioner no. 2 is her mother and there are injuries, out of which two are abrasion and other head injury is said to be fatal.
