The petitioner seeks bail in connection with Didarganj P.S. Case No.44 of 2017 registered under Sections 448, 341, 323, 363 and 366(A)/34 of the Indian Penal Code.

The accusation is that in the night of 01/02.03.2017, Lalu Kumar alongwith one unknown entered into the house of the informant and started to take away his daughter Sangita and when Khusboo, another daughter of the informant, made protest, Lalu Kumar slapped her and taken away Sangita forcibly for the purpose of marriage. When the informant went to Sujita Devi, the sister of Lalu Kumar, to ask regarding the same, she made

Patna High Court Cr.Misc. No.27637 of 2017 (2) dt.12-07-2017 2/2 ignorance. The informant raised suspicion against Lalu Kumar, Rambabu Rai, Sunil Kumar, brother-in-law of Sujita Devi, and this petitioner having their hands in the kidnapping of Sangita Kumari.

Learned counsel appearing on behalf of the petitioner submits that the specific allegation of kidnapping of Sangita, the daughter of the informant, is against Lalu Kumar. The informant has only raised suspicion against the petitioner having his hand in the kidnapping of his daughter Sangita. The petitioner having no criminal antecedent is in custody since 29.03.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Didarganj P.S.
