JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 342, 323, 507 and 504/34 of the Indian Penal Code. And under Sections 25(1-B) a, 26,27 and 35 of Arms Act.
It is alleged that the petitioner with two other accused persons wrongfully confined the informant. Madan Yadav opened fire from his rifle on the informant but the informant did not receive any injury. He was caught with rifle loaded with two live cartridges and was handed over to the police. It is submitted that accusation of firing is not against the petitioner. Nor any recovery has been made from his possession. The petitioner has no criminal antecedent . Statement to this effect has been made in para 3 of the
Patna High Court Cr.Misc. No.1908 of 2015 (2) dt.19-01-2015 2/2 petition.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail , in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfactions of learned C.J.M., Gaya, in Tekari (Panchapur) P.S.Case No. 355/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner that he will co-operate in the investigation till the conclusion of the investigation and in case of non co-operation the learned court below will cancel the bail bonds of the petitioner.
