The petitioner seeks bail in Rail P.S. Case No. 173 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
13.5 litres of foreign liquor is said to have been recovered from the possession of the petitioner at Platform No.1 of Muzaffarpur Railway Station.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in the case at the instance of his enemies by
Patna High Court Cr.Misc. No.12979 of 2018 (2) dt.07-03-2018 2/2 planting aforesaid recovery from his possession. He has no concern with the seized liquor. He has no criminal antecedent and has been languishing in custody since 12.12.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Rail P.S. Case No. 173 of 2017.
