The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 387, 427/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that the petitioners and others demolished the wall and door of the informant and on protest being made the accused persons abused the informant. Subsequently, in the evening the petitioners came, demanded extortion of rupees ten lakhs and assaulted the informant. It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.10319 of 2016 (2) dt.03-03-2016 2/2 petitioners that the petitioners are relatives of the informant and for a petty dispute the accusation has been levelled. Subsequently, the informant has retracted from the initial version and filed a petition to that effect before the learned court below. Moreover, the injury has been found to be simple in nature and a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 215 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
